Since December 2023, the Commission de la fonction publique de Montréal has been entrusted with the responsibility of handling complaints related to psychological and sexual harassment, as well as discrimination and systemic discrimination, for all City of Montreal employees. This presentation will highlight the journey undertaken to implement this significant change, outlining both the benefits that have emerged and the challenges encountered. It will also address the development of the Commission’s expertise in investigations related to discrimination and systemic discrimination, along with the lessons learned and key issues associated with this new responsibility.

The session examines how language proficiency, fluency, and language preference affect evidence gathering, credibility assessment and procedural fairness in workplace investigations.
Taking a closer look at examples from English/ French bilingual investigations, investigations involving ESL participants who communicate in a second language without an interpreter, and interpreter-assisted interviews, the session explores how language differences can unintentionally shape perceptions of credibility and influence investigative outcomes.
